Process for Complaints about Special Constables

Brock University Campus Safety Services is a dedicated team of experienced and skilled professionals who provide a safe and welcoming environment for the Brock campus community.

If you have a concern about the conduct of a Campus Safety Services Special Constable, please contact the Director of Campus Safety Services at dmoody@brocku.ca or 905 688 5550 extension 3585 to discuss your concerns.

If you are unable to resolve your concerns directly with Campus Safety Services and wish to file a formal complaint about themailto:dmoody@brocku.ca conduct of a Brock Campus Safety Services Special Constable, the following process applies. All complaints will be handled in accordance with the requirements of the Community Safety and Policing Act and Ontario Regulation 411/23: Complaints About Special Constables.

  1. Submit a complaint using the complaint form: A complaint about a Special Constable employed by Brock University may be made by submitting the online complaint form available at: https://brocku.ca/campus-safety/contact-us/file-a-complaint/. A print copy of the complaint form is also available at the Campus Safety Services office and the Office of People & Culture. Print forms may be submitted to the Director of Campus Safety Services or the Office of People & Culture. ​Complaints against the Director of Campus Safety Services may be submitted directly to the Office of People & Culture, Executive Director, People Partnerships & Employment Relations.

 

  1. Acknowledgement of complaint: Once a complaint has been received, the complainant will be provided with a written acknowledgment of receipt. Where the form is incomplete, the complainant may be requested to submit a completed form in order for the University to review the complaint.

 

  1. Review of complaint: For complaints against Special Constable officers, the Campus Safety Services Director will review the complaint and, in consultation with the Office of People and Culture, determine the appropriate next steps. Complaints against the Director of Campus Safety Services will be reviewed by the Executive Director, People Partnerships & Employment Relations in the Office of People and Culture. If a complaint alleges conduct that may be criminal, the complaint will be referred to the Niagara Regional Police Service.

 

  1. Investigation of complaint: Complaints against Special Constables will generally be investigated by the Office of People & Culture, or designate, unless the conduct falls within the scope of a University policy under another unit, in which case the Office of People & Culture will arrange for the complaint to be investigated by the applicable unit (e.g. complaints of harassment or discrimination will be referred to the Office of Human Rights and Equity for investigation pursuant to the University’s Respectful Work and Learning Environment Policy, complaints related to privacy will be referred to the University’s Privacy Office for investigation under the Access to Information and Protection of Privacy Policy).

 

Investigations will be completed within 120 days after receiving the complaint. If it becomes apparent that an investigation will not be completed within 120 days, the Office of People & Culture will work with the relevant investigative unit to ensure that notice of the status of the investigation is provided to the complainant and Special Constable respondent every 30 days until the investigation is concluded, unless to do so would prejudice the investigation.

 

  1. Outcome of investigations: If a complaint about the conduct of a Special Constable is investigated by the University, the outcome of that investigation will be communicated in writing to the complainant, the Special Constable, and the Niagara Regional Police Service Board.

​​The University is committed to receiving and addressing complaints in a manner that is consistent with its policies and the law, including but not limited to the Community Safety and Policing Act and associated regulations. Wherever possible, the University will protect the identities of persons involved in the disclosure process, unless the interests of fairness require that the identity be disclosed and put measures in place to protect any employee who raises concerns about the conduct of a Special Constable from reprisal.
