Gateway Suites Agreement 2016-17 (September start)

Every student must read and sign the Gateway Suites Residence Agreement prior to entering residence. In fact, it is a “contract” between the student and the University. This agreement outlines all the rules, policies and important information you need to know about living in Gateway Suites Residence. Students will not be permitted to move into residence until they have completed and signed the Agreement. This agreement is only for residents of Gateway Suites Residence, there is a separate Residence Agreement for the other residences. The following is a copy of the 2016-17 Gateway Suites Residence Agreement.

Period of Residence
In consideration of the payment of the appropriate residence fees and the covenants contained in this agreement on the part of the student, the University agrees to provide accommodation to the student in Gateway Suites Residence from 2pm on September 1, 2016 to conclude either no later than noon on August 19, 2017 or upon termination (see below), whichever occurs first or as otherwise determined in accordance with this agreement.

The student agrees and understands that the acceptance of a place in Gateway Suites Residence constitutes a commitment financially and otherwise by the student for the full residency period provided for in the preceding paragraph. If this agreement is terminated by the student for extraordinary circumstances, the student shall be subject to a forfeiture of fees in accordance with the Early Withdrawal from Gateway Suites Residence procedures. If this agreement is terminated by the University due to the breach of this agreement or any rule of the University by the student, the student shall be subject to a forfeiture of all residence fees for the full 2016-17 contract. Where a student submits documentary evidence with a written appeal following early termination of this agreement, which in the opinion of the University establishes fair and reasonable, compassionate or medical supporting reasons for termination, the University may in its discretion waive adherence to these procedures in whole or in part. Waiver of these procedures by the University in certain circumstances shall not be deemed to be a waiver of these procedures generally.
The University undertakes to avoid unnecessarily disturbing the student but reserves the right after reasonable notice, to change the accommodation assigned to the student if circumstances arise which, in the unfettered discretion of the University, are necessary or desirable. The student may request a change of rooms in accordance with the Room Switch Procedures and with approval from the Department of Residences.

The University shall not be liable for the failure to provide the residential accommodation which is contracted for herein when such failure is caused by fire, explosion, water, Acts of God, civil disobedience or disturbances, strikes or other labour interruptions, vandalism, war, riot, sabotage, failure of public utility services, governmental rules, or any other courses which are beyond the reasonable control of the University (collectively referred to herein as “Emergency” or “Emergencies”).

In the event that Gateway Suites Residence cannot open and/or must close for any such Emergency every attempt will be made to ensure that students are notified in advance and the University will use its best efforts to mitigate against the effects thereof. The University and the Department of Residences are not liable for any loss in these Emergencies. There shall be no compensation in any form whatsoever for inconvenience or discomfort suffered as a result of Emergencies or other circumstances which are beyond the control of the University or the Department of Residences.

In the event that the Gateway Suites Residence cannot open and/or must close due to the actions of third parties with respect to planned or unforeseen renovation or construction, which are beyond the control of the University but not an Emergency, the University shall use its best efforts to notify the students in advance and provide substitute accommodation on- or off-campus.

Residence fees will be determined by the move in date. Fees will be due and payable at the start of each term in the academic year (Fall – September 7, 2016; Winter – January 9, 2017 and; Spring May 1, 2017) and the amount will be set by the Finance Office. All fees must be paid in full by the first day of classes each term. .Any outstanding balances will be subject to service charges (outstanding balances include tuition fees, meal plan, residence fees, incidental fees and any other outstanding fees and charges) as determined by the Finance Office. Service charges will be assessed on the 1st of each month. (See the Fees section in the Brock University Undergraduate Calendar for further details.)

Rules and Provisos
Students living in Residence shall abide by the laws of Canada, the Province of Ontario, the Niagara Region and the City of St. Catharines and the general rules, policies and procedures set by the University. Students are responsible for familiarizing themselves with and abiding by the rules, regulations, policies and procedures of Gateway Suites Residence as set out in in this agreement.

Students are expected to maintain an environment which is conducive to academic work. The following general rules, set by the University, apply to each student:

  • Students are individually responsible for the care and proper use of all University property. Students may either individually or jointly be held responsible for the loss or damage to Gateway Suites Residence, bedrooms or common areas including malfunction of systems and/or appliances. The University assumes no responsibility and is not liable for any loss or damage to the resident’s personal property or injury to person.
  • Regular inspections of units will occur to make sure that they are kept in a reasonable condition and that the fire and life safety equipment is working properly. Students will be notified if special entrance is required for non-emergency maintenance. No notice will be given for emergency maintenance, monthly detector testing, or for requested maintenance. STUDENTS CANNOT REFUSE ENTRANCE TO UNITS FOR MAINTENANCE, DETECTOR TESTING, EMERGENCIES OR INSPECTIONS.
  • Students are expected to ensure that their living environment is safe and free from life safety hazards. Residents, guests, and staff are expected to exercise care and good judgment with regard to their own personal safety and the safety of others as it relates to fire and life safety in the building. Tampering with equipment, interfering with and/or failing to use equipment properly are not permitted.

The following is prohibited in and around Gateway Suites Residence: behaviour by an individual(s) that interferes with the rights of another individual(s) to the peaceful use and enjoyment of his or her space in residence; behaviour that creates a significant nuisance and/or disturbance to an individual or community; behaviour which endangers the safety and security of themselves or another individual(s), and/or compromises personal or university property, and/or attacks the dignity/integrity of an individual, and/or break the laws of the land.

Gateway Suites Residence, is a smoke-free environment and smoking is strictly prohibited in Gateway Suites Residence. Smoking at the University is only permitted in designated smoking areas.

Pets are not allowed in Gateway Suites Residence (not even as visitors to your residence). Only non-dangerous fish in aquariums no larger than 5 gallons are permitted. If a student chooses to have such a tank, they are responsible for ensuring its maintenance. No debris from the tank (including rocks/gravel) may be put down any drain in Gateway Suites Residence. (Please note: Certified service animals are permitted in Gateway Suites Residence, they must be identified as required upon application to the building and receive approval through our Medical and Special Consideration process.)

The University reserves the right to amend or make additional rules and regulations concerning Gateway Suites Residence, which shall form part of this agreement and the student hereby agrees to be bound by such amendments or additions.

The student agrees that, in the event of any breach of any term or condition of this agreement, or of any rule of the Residence as determined by the University, the student may, at the discretion of the University, be subject to sanctions including termination of this agreement and eviction from Gateway Suites Residence. Any student remaining on University property unlawfully shall be subject to the provisions of the Trespass to Property Act, R.S.O. 1990, c. T.21 (as amended).
