{"id":87363,"date":"2023-08-17T11:53:04","date_gmt":"2023-08-17T15:53:04","guid":{"rendered":"https:\/\/brocku.ca\/brock-news\/?p=87363"},"modified":"2024-09-01T09:54:31","modified_gmt":"2024-09-01T13:54:31","slug":"opinion-blayne-haggart-and-natasha-tusikov-discuss-digital-policy-and-governments-public-consultation-record","status":"publish","type":"post","link":"https:\/\/brocku.ca\/brock-news\/2023\/08\/opinion-blayne-haggart-and-natasha-tusikov-discuss-digital-policy-and-governments-public-consultation-record\/","title":{"rendered":"OPINION: Blayne Haggart and Natasha Tusikov discuss digital policy and government&#8217;s public-consultation record"},"content":{"rendered":"<p><em>This article written by Blayne Haggart, Associate Professor of Political Science at Brock University, and Natasha Tusikov, Associate Professor of Criminology at York University, was originally published in <a href=\"https:\/\/theconversation.com\/the-canadian-governments-poor-track-record-on-public-consultations-undermines-its-ability-to-regulate-new-technologies-211602\" target=\"_blank\" rel=\"noopener\">The Conversation<\/a>.<\/em><\/p>\n<p>Over the last five years, Canada\u2019s federal government has announced a litany of much-needed plans to regulate big tech, on issues ranging from\u00a0social media harms,\u00a0Canadian culture\u00a0and\u00a0online news\u00a0to the\u00a0right-to-repair\u00a0of software-connected devices, and\u00a0artificial intelligence\u00a0(AI).<\/p>\n<p>As digital governance scholars who have\u00a0just published a book\u00a0on the transformative social effects of data and digital technologies, we welcome the government\u2019s focus on these issues.<\/p>\n<p><strong>Difficult conversations<\/strong><\/p>\n<p>By engaging with the public and experts in an open setting, governments can \u201ckick the tires\u201d on various ideas and build a social consensus on these policies, with the aim of creating sound, politically stable outcomes. When done well, a good public consultation can take the mystery out of policy.<\/p>\n<p>For all their plans, the Liberal government\u2019s public-consultation record related to digital policy has been abysmal. Its superficial engagements with the public and experts alike have undermined essential parts of the policymaking process, while also neglecting their responsibility to raise public awareness and educate the public on complex, often controversial, technical issues.<\/p>\n<p><strong>Messing up generative AI consultations<\/strong><\/p>\n<p>The most recent case of a less-than-optimal consultation has to do with\u00a0Innovation, Science and Economic Development Canada\u2019s (ISED)\u00a0attempts to stake out a regulatory position on generative AI.<\/p>\n<p>The government\u00a0apparently\u00a0started consultations about\u00a0generative AI in early August, but news about them\u00a0didn\u2019t become public until Aug. 11. The government later confirmed on Aug. 14 that ISED \u201cis conducting a brief consultation\u00a0on generative AI with AI experts, including from academia, industry, and civil society on a voluntary code of practice intended for Canadian AI companies.\u201d<\/p>\n<p>The consultations are slated to close on Sept. 14.<\/p>\n<p>Holding a short, unpublicized consultation in the depths of summer is almost guaranteed to not engage anyone outside of well-funded industry groups. Invitation-only consultations can potentially lead to biased policymaking that run the risk of not engaging with all Canadian interests.<\/p>\n<p><strong>Defining the problem<\/strong><\/p>\n<p>The lack of effective consultation is particularly egregious given the novelty and controversy surrounding generative AI, the technology that burst into public consciousness last year with the unveiling of\u00a0OpenAI\u2019s ChatGPT chatbot.<\/p>\n<p>Limited stakeholder consultations are not appropriate when there exists, as is the case with generative AI, a dramatic lack of consensus regarding its potential benefits and harms.<\/p>\n<p>A loud contingent of engineers claim that they\u2019ve created\u00a0a new form of intelligence, rather than a powerful,\u00a0pattern-matching autocomplete machine.<\/p>\n<p>Meanwhile,\u00a0more grounded critics\u00a0argue that generative AI has the potential to disrupt entire sectors, from\u00a0education\u00a0and the\u00a0creative arts\u00a0to\u00a0software coding.<\/p>\n<p>This consultation is taking place in the context of an AI-focused\u00a0bubble-like investment craze, even as a growing number of experts question its\u00a0long-term reliability. These experts point to generative AI\u2019s\u00a0penchant for generating errors (or \u201challucinations\u201d)\u00a0and its\u00a0negative environmental impact.<\/p>\n<p>Generative AI is poorly understood by policymakers, the public and experts themselves. Invitation-only consultations are not the way to set government policy in such an area.<\/p>\n<p><strong>Poor track record<\/strong><\/p>\n<p>Unfortunately, the federal government has developed bad public-consultation habits on digital-policy issues. The government\u2019s 2018 \u201cnational consultations on digital and data transformation\u201d were unduly limited to the economic effects of data collection, not its broader social consequences, and problematically excluded governmental use of data.<\/p>\n<p>The generative AI consultation followed the government\u2019s broader efforts to regulate AI in C-27, The Digital Charter Implementation Act, a bill that academics have\u00a0sharply critiqued for lacking effective consultation.<\/p>\n<p>Even worse has been the government\u2019s nominal consultations toward an online harms bill. On July 29, 2021 \u2014 again, in the depths of summer \u2014 the government released a\u00a0discussion guide\u00a0that presented Canadians with a legislative agenda, rather than surveying them about the issue and highlighting potential options.<\/p>\n<p>At the time, we argued that\u00a0the consultations narrowly conceptualized both the problem of online harms caused by social media companies and potential remedies.<\/p>\n<p>Neither the proposal nor the faux consultations satisfied anyone, and the government withdrew its paper. However, the government\u2019s response showed that it had failed to learn its lesson. Instead of engaging in public consultations, the government held a series of \u201croundtables\u201d with \u2014 again \u2014 a number of hand-picked representatives of Canadian society.<\/p>\n<p><strong>Fixing mistakes<\/strong><\/p>\n<p>In 2018, we outlined\u00a0practical steps the Canadian government could take from Brazil\u2019s very successful digital-consultation process\u00a0and subsequent implementation of its 2014\u00a0Internet Bill of Rights.<\/p>\n<p>First, as Brazil did, the government needs to properly define, or frame, the problem. This is a not straightforward task when it pertains to new, rapidly evolving technology like generative AI and large language models. But it is a necessary step to setting the terms of the debate and educating Canadians.<\/p>\n<p>It\u2019s imperative that we understand how AI operates, where and how it obtains its data, its accuracy and reliability, and importantly, possible benefits and risks.<\/p>\n<p>Second, the government should only propose specific policies once the public and policymakers have a good grasp on the issue, and once the public has been canvassed on the benefits and challenges of generative AI. Instead of doing this, the government has led with their proposed outcome: voluntary regulation.<\/p>\n<p>Crucially, throughout this process, industry organizations that operate these technologies should not, as they have been in these stakeholder consultations, be the primary actors shaping the parameters of regulation.<\/p>\n<p>Government regulation is both legitimate and necessary to address issues like online harms, data protection and preserving Canadian culture.
