JURY OUT IN NEARING CASE.

Foreman Reports Several Refuse to Discuss Evidence
The jury in the case of Scott Nearing, former Professor in the University of Pennsylvania and the University of Toledo, and of the American Socialist Society, indicted on a charge of violating the Espionage act, retired yesterday afternoon to consider the verdict. Shortly before 1 o’clock this morning, having failed to reach an agreement, the jury was locked up for the night.
In his charge to the jury, Federal Judge Julius M. Mayer said that nobody denied the citizens of this country the right of free speech or writing. Reading the amendment to the Constitution wherein this right is set forth, Judge Mayer declared it was important to understand that not all speech or writing was free in a loose sense.
